Privacy

Majellacase immobiliare sas (hereinafter also ‘MAJELLACASE’ or the ‘Company’) is committed to the protection of personal data entrusted to it. Therefore, the management and security of such data is guaranteed with the utmost care, in accordance with the requirements of the privacy regulations, in full respect of the principles of lawfulness, correctness and transparency.
In accordance with current legal provisions on privacy (in particular EU Regulation 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data), this notice explains who the Data Controller is, for what purposes MAJELLACASE may use the data provided, how it will handle it, to whom it may be disclosed, where it may be transferred and what the data subject's rights are.
WHO WILL PROCESS THE DATA PROVIDED
The data provided will be processed, in the capacity of Data Controller, by MAJELLACASE, based in Frazione Scagnane, snc - 65023 Caramanico Terme (PE) - ITALY.
PERSONAL DATA PROCESSED AND PURPOSE OF PROCESSING
The personal data collected both on paper and electronically that are subject to processing relate to:
  • identification, administrative, accounting, tax and commercial data of interested parties (such as members of corporate bodies, employees, staff of third parties with whom the customer has a business relationship);
  • credit card data;
  • Utente/password di accesso a programmi (es. adwords, facebook, linkedin).
This data, of which the Customer is legitimately in possession, is provided by him in the performance and execution of pre-contractual/contractual relations with the Controller.
Data may be processed for the following purposes:
  • A. sending quotes to companies/individuals who are already customers/potential customers;
  • B. performance of services requested by customers;
  • C. monitoring of receipts;
  • D. fulfilment of legal obligations (e.g. accounting, tax obligations);
  • E. exercise of the holder's right of defence in court;
  • F. sending of communications - commercial information (e.g. newsletters, invitations to events, ways of obtaining a gadget or a promotion) to Customers - suppliers/potential Customers - suppliers of MAJELLACASE's Customer companies, in the case of data acquired directly from the Company (e.g. via landing pages);
  • G. sending to Clients/potential Clients of MAJELLACASE communications - commercial information (e.g. newsletters, invitations to events, other commercial information).
NATURE OF CONTRIBUTION
The Company will process the data referred to in the preceding points:
  • A., B. and C. because it is necessary for (i) the performance of pre-contractual activities for the development of a contract proposal and (ii) the performance of services requested by the Customer;
  • D. insofar as it is necessary to comply with a legal obligation to which the Company is subject;
  • E. as it is necessary for the pursuit of the Company's legitimate interest in protecting its rights in the event of legal disputes;
  • F. and G. on the basis of the Customer's consent; the Customer shall always be given the opportunity to revoke his consent in the manner provided for in the following paragraphs.
The provision of data for the purposes:
  • A., B., C. and E. is necessary for the performance of contractual and/or pre-contractual activities by the Company;
  • D is compulsory and any refusal on the part of the person concerned will make it impossible for the Company to pursue the purposes described in the preceding paragraph;
  • F. and G. is optional, however, failure to provide such data will make it impossible for The Company to pursue the stated purposes.
The extent and adequacy of the data provided will be assessed on a case-by-case basis to determine the consequent decisions and to avoid the processing of data that is excessive in relation to the purposes pursued.
The Company undertakes not to use the personal data provided for purposes other than and in addition to those described in this information notice, without first informing the person concerned and, where necessary, obtaining his or her consent.
MODE OF TREATMENT
The processing of the data is carried out by means of computerised procedures or, in any case, by telematic means or paper media, with logic strictly related to the purposes themselves and, in any case, in such a way as to guarantee the security of the same and always in compliance with the relevant legislation in force, in particular EU Regulation 679/2016.
The data will also be:
  • processed by Company resources, adequately trained and committed to confidentiality, acting as authorised data processing personnel;
  • stored by means that guarantee their security, integrity and confidentiality, through the adoption of appropriate security measures as provided for by the regulations.
RETENTION PERIOD
With reference to processing for the purposes:
  • A., B., C., D. and E., The Company shall process personal data for the time necessary to fulfil these purposes and, in any case, for a period not exceeding 10 years from the termination of the last contractual relationship with the Customer. The data may also be retained beyond that period in connection with the possible need to use them in court in the event of litigation, or in any other case in which the legitimate interests of the Company prevail over the interests or fundamental rights and freedoms of the data subject;
  • F. and G., the data will be retained until the person concerned revokes his or her consent in the manner made available by the Company for this purpose.
COMMUNICATION AND DISSEMINATION
The data collected will not be disclosed or disseminated outside the company.
The data may be communicated, by virtue of the development of the relationship with the Customer to
  • public entities, to fulfil legal obligations or to exercise the rights of the company (e.g. the right of defence in court);
  • private entities and bodies established within the Italian state entrusted, through contractual agreements, with the performance of services (technical, IT and administrative/accounting support) strictly related to the purpose for which the data are provided by the data subject.
The Company would like to inform you that if, as a function of the development of its organisation or agreements with new suppliers, it becomes necessary to transfer data outside the European Union, this transfer will take place in accordance with the applicable legal provisions (Art. 45 para. 1 GDPR, Transfer on the basis of an adequacy decision, or Art. 46, Transfer subject to adequate safeguards).
RIGHTS OF THE DATA SUBJECT AND HOW TO EXERCISE THEM
Please note that EU Regulation 679/2016 (in particular, Chapter III thereof) grants the interested party certain rights, for the exercise of which he/she may apply to the Company, by writing to Majellacase immobiliare sas, Frazione Scagnane, snc - 65023 Caramanico Terme (PE) - ITALY or by emailing info@majellacase.it.
In particular, these rights are set out in the GDPR in the articles:
  • 13, Information to be provided when personal data are collected from the data subject. In particular, we highlight what is indicated in paragraph 2. point d) concerning the right to lodge a complaint with the Garante della protezione dei dati personali;

  • 16, Right of rectification;
  • 17, Right to erasure (“right to be forgotten”);
  • 18, Right to restriction of processing;
  • 19, Obligation to notify in case of rectification or deletion of personal data or restriction of Processing;
  • 20, Right to data portability;
  • 21, Right of Opposition;
  • 22, Automated decision-making process concerning natural persons, including profiling.
The Data Controller endeavours to deal with the data subject's request to the best of its ability in order to guarantee the effective exercise of his rights.
